Making decisions: a guide for people who work in health and social care
April 1 2009This guidance published by the Office of the Public Guardian explains to health and social care workers how the Mental Capacity Act 2005 affects anyone who is unable to make some or all decisions for themselves.
The inability to make a decision could be because of a learning disability, mental health problems, brain injury, dementia, alcohol or drug misuse, side effects of medical treatment or any other illness or disability.
People who work in health and social care are affected by the Mental Capacity Act 2005 and need to know about it. This booklet provides a broad overview of the Act and its main implications health and social care workers. It is not about detention or compulsory treatment under the Mental Health Act 1983.
This booklet contains a list of sources of further information and refers practitioners to the Mental Capacity Act Code of Practice which has more detailed information and guidance.
