The Duty of Candour is seen as an important step towards ensuring that when things go wrong in healthcare, lessons are learnt and improvements are made. Alongside this, patients should feel that they are being dealt with in a fully transparent and honest manner meaning that healthcare professionals are obligated to communicate any failings in care provision to the patient and their families.

The Duty of Candour came into force for NHS bodies in November 2014 and for all other care providers regulated by the Care Quality Commission on the 1st April 2015. It is therefore imperative that all care providers and their teams are fully briefed and up to speed with the Duty of Candour. Failure to comply with the statutory Duty of Candour will amount to an offence and potential prosecution in the magistrates court.
